Prohibited Conduct and Reporting Procedures

Orange Coast College is committed to maintaining a safe, inclusive, and nondiscriminatory environment for all students, employees, and visitors. In alignment with federal Title IX regulations, California law, and District policy, the following are considered Prohibited Conduct:

  • Sexual Harassment (including quid pro quo harassment and hostile environment harassment)
  • Sexual Assault (including rape, fondling, incest, and statutory rape)
  • Sexual Violence (including sexual battery and sexual exploitation, as defined under California law)
  • Relationship Violence (dating violence and domestic violence)
  • Stalking
  • Retaliation (adverse treatment for reporting, disclosing, or participating in a resolution process)

AP 5910 Title IX and Title 5 Sexual Misconduct

Coast Community College District Administrative Procedure 5910 Title IX and Title 5 Sexual Misconduct – Interim Administrative Procedure covers sexual and interpersonal violence and harassment in accordance with federal and state law. Because federal Title IX regulations and California law intersect in specific ways, the District uses a two-part policy:

  • Title IX (Section A): Applies to incidents that meet federal Title IX definitions and requirements.
  • Title 5 / California Law (Section B): Applies to incidents that may not fall under Title IX but are still covered under California law, the federal Clery Act, or District policies.

Accountability for Offenders

Acts of sex discrimination and sex-based harassment, including relationship violence, sexual harassment, sexual assault, and stalking have serious consequences, including campus sanctions, criminal prosecution, and civil penalties.

Campus Sanctions:

Sanctions are consequences imposed on students or employees found responsible for violating District policies.
  • For Students: Sanctions are outlined in BP/AP 5500 Student Code of Conduct and may include:
    • Disciplinary probation.
    • Suspension or expulsion.
    • Educational assignments or corrective measures.
  • For Employees: Sanctions follow BP/AP 3435 Prohibition of Discrimination and Harassment and collective bargaining agreements and may include:
    • Formal reprimands.
    • Mandatory training.
    • Termination or other disciplinary actions.

Legal Consequences:

Offenders may face criminal prosecution, fines and other court-ordered damages, imprisonment, and civil lawsuits financial compensation related to medical expenses, therapy and counseling costs. lost wages and emotional distress.
